Simply put, the Fair Trade Housing Act of 1968 brought into law the idea that no individual wanting to buy or rent a home could be discriminated against based upon their race, color, sex, physical disability, religion or natural origin. The act was designed to help keep the prevalent discrimination in check that was common in the housing industry during the time.
Even if we don`t want to admit it, the Fair Trade Housing Act is something that touches us even today. The Fair Trade Housing Act means that a seller or developer cannot refuse to sell a home, come to an understanding about the selling price, make the property unavailable, or refuse to provide a suitable living space to someone based only on the traits listed above.
The Fair Trade Housing Act also covers the activity of financial institutions. The lender is required to not based their lending decisions on someone`s race, color, sex, natural origin, or physical condition to name a few.
The act also makes it illegal for sellers or lenders to intimidate, coerce, threaten or otherwise hinder people pursuing their rights under this act. It is also illegal for sellers or developers to advertise special deals or limitations based on someone`s national origin, color, race, religion, sex, familial status, or handicap.
There are also benefits to the physically handicapped in this act. The apartment you live in as well as the common areas must be made accessible whereever possible. Also, the building supervisor must be willing to make reasonable exceptions to rules policies, and services they provide in regards to the disability being discussed. Changes in policies can include allowing service animals in a no pets apartment, or alloting extra electrical power to an apartment to install a washer and dryer if the person cannot make it to to the common laundry room.
When a new building is being erected, it must comply with certain things to bring it in line with the Fair Trade Housing Act If the building is larger than a three unit structure and has a elevator, all must be brought into compliance with the American with Disabiliteis Act.
